<strong><em>FARGO, NORTH DAKOTA     </em></strong>Have you lost money with financial advisor Michael Young of Fargo, North Dakota?  Our law firm is looking into claims made by a customer of Young, who provided investment advisory services through Classic Asset Management.  According to the complaint, he was negligent in recommending <strong><a href="/practice-areas/" rel="noopener" target="_blank">leveraged ETFs</a></strong> and caused $130,000 in damages.  <strong><a href="https://www.finra.org/rules-guidance/notices/09-31" rel="noopener noreferrer" target="_blank">FINRA</a></strong> has previously warned about the dangers of using leveraged ETFs.</p>


<p>Michael Young has been a financial advisor and registered representative of Classic LLC since 2012.  He has also been an investment advisory representative of Classic Asset Management since 2006.  He operates a Fargo, North Dakota office, and is also registered with Aurora Securities and Secure Asset Management.</p>


<p>Investment advisors are considered to be fiduciaries of their customers, meaning that the advisor has to put their customers’ interest before their own.  Violations of industry rules can be evidence that the advisor violated his fiduciary duty to a client, which can result in financial liability.</p>

<h1 class="wp-block-heading"><em><strong>Philip Riposo Fired By United Planners Financial Services</strong></em></h1>

<em><strong>NEW BEDFORD, MASSACHUSETTS and CAVE CREEK, ARIZONA</strong></em>
<strong> </strong>Have you lost money with Philip Riposo, a financial advisor formerly with United Planners Financial Services in New Bedford, Massachusetts?  Riposo was recently discharged by United Planners Financial Services, regarding allegations that he created fake statements from Zurich Kemper Investments and provided them to clients.</p>


<p>Riposo also allegedly had clients write checks out to his own firm, Riposo Asset Management, which is not allowed by his former brokerage firm.  According to <strong><a href="https://www.finra.org/investors/investing/working-with-investment-professional/about-brokercheck" rel="noopener noreferrer" target="_blank">FINRA BrokerCheck</a></strong>, Philip Riposo allegedly used those checks for personal expenses.</p>


<p>Philip Riposo worked at offices in New Bedford, Massachusetts, but he also was assigned to an office in Cave Creek, Arizona.  Riposo had been with United Planners Financial Services from December 2015 to March 2022.</p>


<p>Generally, financial advisors or stockbrokers should not accept checks that are written to the advisor or their direct business.  The checks generally should be written out to the licensed brokerage firm that they work for, or to the issuing company (such as a mutual fund, annuity, etc.).  Accepting checks from client and sending fictitious statements is often a <strong><a href="/practice-areas/advisor-negligence-and-fraud/" rel="noopener" target="_blank">sign of fraud</a></strong>.</p>

<p><strong>BRECKSVILLE, OHIO</strong>
<strong> </strong>Have you lost money with financial advisor Albert DeGaetano, formerly with Edward Jones in Brecksville, Ohio?  We are looking into allegations made against Albert DeGaetano. DeGaetano was suspended from the securities industry for six months and fined $7,500 by FINRA.  FINRA was <a href="https://www.finra.org/sites/default/files/fda_documents/2019061737101%20Albert%20L.%20DeGaetano%20CRD%202458569%20AWC%20sl.pdf" rel="noopener noreferrer" target="_blank">investigating</a> whether DeGaetano had exercised discretion in a customer’s account without written authority to do so. DeGaetano was alleged to have made 470 unauthorized transactions.</p>


<p>Albert DeGaetano was with Edward Jones from September 2015 to February 2019.  He is now with Sowell Management.  He has worked at branch offices in Brecksville, Ohio.  DeGaetano has also been the subject of one customer complaint, and he was also fired by Edward Jones and another firm.</p>


<p>Brokerage firms like Edward Jones have a responsibility to adequately supervise all representatives who are registered through their firm.  Brokerage firms also must take steps to ensure that their financial advisors follow all securities rules and regulations, as well as internal firm policies.  When brokerage firms fail to adequately supervise their registered representatives, <a href="/practice-areas/" rel="noopener" target="_blank"><strong>they may be liable for investment losses</strong> </a>sustained by customers.</p>

<p>Have you lost money with financial advisor Steven Muntin from Flint, Michigan?  We are looking into allegations against Steven Muntin by the SEC.  Muntin was <a href="https://www.sec.gov/litigation/litreleases/2021/lr25255.htm" rel="noopener noreferrer" target="_blank">civilly charged</a> with defrauding an investor.
