Allegations Regarding the Expulsion

In January 2026, Fiallo agreed to the expulsion from FINRA, after it was alleged that she refused to cooperate fully with a FINRA investigation.  FINRA was looking into allegations that she borrowed money from a customer.  Generally, brokers cannot borrow money from customers, with limited exceptions.  It was further alleged that she has not repaid the money.

Lyhen Fiallo was licensed with PFS Investments from April 2020 to December 2024.   She worked in a Hialeah, Florida office.  She was also licensed to sell insurance through Primerica Financial Services.

In June 2025, Eric Fiallo of Hialeah, Florida was terminated by PFS Investments (Primerica) regarding allegations that he borrowed money from a securities customer.  Under FINRA Rule 3240, advisors are generally prohibited from borrowing money from clients, with limited exceptions.

That termination led FINRA to start its own investigation into Fiallo.  When he refused to produce documents to FINRA as part of its investigation, he was barred by FINRA.

Eric Fiallo was licensed with PFS Investments (Primerica) from 2008 to June 2025.  He worked in an office in Hialeah, Florida.  He was also the subject of a tax lien in 2024, and a small civil judgment in early 2025.

FARMINGTON HILLS, MICHIGAN Did you invest with Gary Harpe, formerly with PFS Investments (Primerica) in Farmington Hills, Michigan? Our securities arbitration law firm is looking into claims made by FINRA (the Financial Industry Regulatory Authority) against advisor Gary Harpe. FINRA brought a complaint seeking to expel him from the securities industry.

FINRA started looking into Gary Harpe after he was criminally charged with larceny by conversion in Farmington Hills, Michigan for more than $1,000 but less than $20,000. He has pleaded not guilty, and the case is still pending. Harpe was terminated by PFS Investments (also known as Primerica) in 2023, and was with PFS Investments from 1998 to January 2023.

FINRA Rule 821 provides that advisors are required to respond to FINRA investigations. Additionally, under FINRA’s supervisory rules, securities brokerage firms must adequately supervise their representatives. If firms like PFS Investments fail to provide sufficient supervision, the firms could be responsible for financial damages.

CONCORD, CALIFORNIA Have you invested with financial advisor Sean Fields from Concord, California? In January 2024, he was fired by his brokerage firm, PFS Investments. Fields was under internal investigation by his brokerage firm, whereby he allegedly admitted that he borrowed from two customers. Generally, financial advisors cannot borrow money from clients, with limited exceptions, and the advisor must get prior approval to borrow money from clients.

Sean Fields held his securities license with PFS Investments from 2015 to January 2024. He also held his insurance licenses with Primerica Financial Services.

FINRA Rule 3240 provides for circumstances in which an advisor can borrow from a customer. Moreover, under FINRA Rule 3111, Brokerage firms are required to have written supervisory and compliance procedures. If the firm failed to reasonably supervise its representatives, it may be liable for customer losses.
