FINRA’s Allegations Regarding Spivey

According to a recent Letter of Acceptance, Waiver, and Consent (AWC) filed by FINRA, the regulator was investigating whether Spivey’s investment recommendations were in the best interests of a customer.  FINRA requested that he appear for an on-the-record interview, but he acknowledged that he would not appear for the interview.  Under FINRA Rule 8210, FINRA barred him from the securities industry.

Background on Donald Spivey

From 2005 to October 2023, Donald Spivey had been a representative of Carter Terry & Company.  He was assigned to a Camden, South Carolina office.  He also previously worked with Morgan Stanley, Paine Webber, and other firms.

Responsibility for Spivey’s Conduct

Carter Terry & Company has an obligation to review its advisors’ conduct and take necessary action if potential securities violations are involved.  If the firm fails to adequately do so, it could be responsible for any investor losses.
